Introduction and Acceptance of Terms Andaza, operated by Andaza Technologies Private Limited (“Andaza”, “we”, “us”, or “our”), provides an opinion trading platform and associated services (collectively, the “Services”). By accessing or using Andaza, you agree to comply with these Terms and Conditions and all other rules and policies provided by Andaza.
These features are designed to offer an immersive and skill-based experience, allowing users to leverage their knowledge and analytical abilities across various domains.
By accessing or using the Andaza Platform, you (“User” or “you”) agree to be bound by these Terms and Conditions, our Privacy Policy, and all other rules, policies, and terms of use referenced herein or provided by Andaza in relation to the Andaza Platform (collectively, the “Andaza Services”).
Andaza reserves the right to modify these Terms and Conditions at any time. We will notify users of significant changes via email or through the Andaza Platform. Your continued use of Andaza after such modifications constitutes your acceptance of the updated terms.
The Andaza Platform is open only to individuals who are at least 18 years old. Persons under 18 are strictly prohibited from using the Andaza Platform.
Currently, the Andaza Platform is available only to residents of India. Users must ensure they comply with all local, state, and national laws and regulations.

Andaza provides a platform for users to participate in opinion trading markets and access related information and analytics.
Users may have the ability to submit, post, or display content on the Andaza Platform (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant Andaza a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with the Andaza Services.
Andaza reserves the right to modify, suspend, or discontinue any part of the Andaza Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Andaza Services.
Users agree to comply with all applicable laws, regulations, and third-party rights (including without limitation laws regarding the import or export of data or software, privacy, and local laws) while using the Andaza Platform.

Andaza reserves the right to investigate and take appropriate legal action against anyone who, in Andaza's sole discretion, violates this provision, including without limitation, removing the offending content from the Andaza Platform, suspending or terminating the account of such violators, and reporting them to law enforcement authorities.
The Andaza Platform contains material, such as software, text, graphics, images, and other material provided by or on behalf of Andaza (collectively referred to as the “Andaza Content”). The Andaza Content is protected by copyright, trademark, patent, trade secret, and other laws. Andaza owns and retains all rights in the Andaza Content and the Andaza Services.
Andaza grants you a limited, revocable, non-transferable, and non-exclusive license to use the Andaza Content solely for your personal, non-commercial purposes in connection with the Andaza Services.

At Andaza, we charge a 15% commission on all net winnings. (Note: You can adjust this percentage based on your business model.)
Andaza uses third-party payment processors to facilitate payments. By using these payment services, you agree to comply with their terms and conditions.
You represent and warrant that you have the legal right to use any payment method(s) you provide in connection with your Andaza account.
Andaza maintains different types of account balances for users, including but not limited to a Deposits Account, Winnings Account, and Bonus Account.
Withdrawal of funds from your Andaza account is subject to certain conditions and limitations, which may be modified from time to time at Andaza's discretion.
THE ANDAZA SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ANDAZA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANDAZA, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE ANDAZA SERVICES.
You agree to indemnify, defend, and hold harmless Andaza, its affiliates, officers, directors, employees, consultants, agents, and representatives from any and all third-party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your access to or use of the Andaza Services, your violation of these Terms and Conditions, or your infringement of any intellectual property or other right of any person or entity.
Andaza reserves the right to terminate or suspend your account and bar access to the Andaza Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions.
You may terminate your account at any time by contacting us at support@andaza.in Upon termination, your right to use the Andaza Services will immediately cease.
All provisions of these Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms and Conditions, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of the arbitration shall be [Gurugram, Haryana]. The language of the arbitration shall be English.
These Terms and Conditions constitute the entire agreement between you and Andaza concerning the Andaza Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Andaza.
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect and enforceable.
Andaza shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Andaza's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.
These Terms and Conditions are personal to you and are not assignable, transferable, or sublicensable by you except with Andaza's prior written consent. Andaza may assign, transfer, or delegate any of its rights and obligations hereunder without consent.
